"Joseph Watts, cab proprietor, Durham Street, Newcastle, brought an action against Charles Wells and the Newcastle and Gateshead Water Company to recover twenty six pounds ten shillings three pence for damages sustaned to a cab and horse through the alleged negligence of the defendants. On the night of the 14th March, which was a very stormy night, plaintiff was driving Mr and Mrs Howard Pease home at the west end of the town. On proceeding up the back of Park Road one of the horses slipped, and immediately afterwards the cab gave a lurch, and the wheels went into what was found to be an excavation. Mr and Mrs Pease were got out as quick as possible. Mrs Pease found shelter in one of the houses, and Mr Pease assisted plaintiff in getting the cab out. More than an hour was occupied in getting the horse out. The defendant Wells had been digging there in order to connect some houses he was building with the drainage system. Wells's men had laid bare a water pipe belonging to the Water Company, and at the time the horse fell into the hole that pipe had burst, and was playing upon the opposite wall. The plaintiff contended, therefore, that it assisted in making the hole that Wells's men had left. The horse was injured, and had to be examined by a veterinary surgeon. For the damage to the cab plaintiff had paid eighteen shillings six pence, for injury to the harness one pound nine shillings nine pence, and for the services of the veterinary surgeon one pound twelve shillings. The horse was laid up five weeks, and had suffered permanent injury to the extent of five pounds five shillings from his value. Plaintiff had to hire a cab and harness during the repair of this own, and altogether he claimed twenty six pounds ten shillings three pence damages. Evidence having been called on both sides, the jury gave a verdict for the plaintiff, finding the defendant Wells liable on the ground that he should have had a proper light or signal for protection."
